1. Appointment
A prospective mediator shall accept an appointment only if fully confident that they can perform their duties impartially and devote the necessary time and attention expected by the parties.
2. Neutrality
The mediator shall ensure fairness in decision-making based on objective facts disclosed during the proceedings, including:
2.1 Avoiding any conduct or statements indicating bias toward or against any party.
2.2 Remaining unaffected by external pressures, including public opinion.
2.3 Refraining from accepting benefits, directly or indirectly, from any party involved in the mediation.
2.4 Withholding their personal views on the mediation process from the parties.
3. Independence
The mediator shall disclose any circumstances that may cast doubt on their independence.
4. Procedural Fairness
In performing their duties, the mediator shall:
4.1 Provide equal opportunities for all parties to present their arguments and evidence.
4.2 Seek input from the parties regarding potential methods for resolving the dispute.
4.3 Objectively assess damages and consider appropriate remedies.
4.4 Adhere to agreed-upon timelines for dispute resolution and avoid unnecessary delays.
4.5 Respect the rights and interests of all parties without exception.
4.6 Follow agreed-upon mediation procedures.
4.7 Take necessary measures to protect parties’ interests and maintain confidentiality if unable to complete assigned tasks.
4.8 Not delegate any duties to third parties.
5. Confidentiality
The mediator shall:
5.1 Safeguard the confidentiality of all information and data entrusted during mediation.
5.2 Handle data diligently and circulate it only as necessary for dispute resolution.
5.3 Refrain from requesting or collecting excessive information about the parties.
5.4 Limit dissemination of parties' data according to the Mediation Center’s guidelines.
6. Communications
The mediator shall:
6.1 Refrain from engaging in individual communications with any party and promptly inform all parties and mediators of any such communication.
6.2 Avoid negotiating fees directly or indirectly with any of the parties.
7. Disclosure
The prospective mediator shall:
7.1 Disclose any facts or circumstances that might raise doubts about their impartiality or independence, with a continuing obligation to disclose throughout the mediation.
7.2 Disclose to the Center and any party seeking appointment:
(a) Any past or present personal or business relationships with any party, their representatives, or potential key witnesses.
(b) The extent of their prior knowledge of the dispute.
